Sweep It Poker Terms of Use

NOTE: THIS GAME AND THE SERVICES PROVIDED HEREIN DO NOT OFFER “REAL MONEY GAMBLING.” ELIGIBLE USERS MAY HAVE THE OPPORTUNITY TO WIN GALA TOKENS OR PRIZES BASED ON ENTRY INTO SWEEPSTAKES, ALL OF WHICH ARE SUBJECT TO OFFICIAL RULES GOVERNING EACH SWEEPSTAKES.

Welcome to the Terms of Use (“Game Terms”) for Blockchain Game Partners Inc. dba Gala Games’s ( “GALA”, “We”, “Us”, or “Our”) game, Sweep It Poker (the “Game”), and all associated GALA services provided at or through the Game (collectively, “PGP”), however accessed and/or used, whether via personal computers, mobile devices, tablets, handheld devices, or through other interactive services, features, applications, and downloads (collectively, “Websites”). These Game Terms are in addition to, and not in lieu of, your rights and obligations under the GALA Terms and Conditions (“GALA Terms and Conditions”). Capitalized terms not defined in the Game Terms have the meanings assigned to them in the GALA Terms and Conditions. To the extent there is a conflict between these Game Terms and the GALA Terms and Conditions, these Game Terms will govern such conflict.

Customers, users, and others who download, access, use, and/or play (collectively, “play”, “playing”, “use” or “using”) PGP (“You”, “Your”, “Users”) do so under these Game Terms and subject to the GALA Terms and Conditions, and any other terms, policies and/or rules incorporated or referenced therein, including without limitation GALA’s Privacy Policy.

PLEASE READ THESE TERMS OF USE CAREFULLY. BY USING PGP, YOU ARE EXPLICITLY ACKNOWLEDGING THAT YOU UNDERSTAND THE GAME TERMS, AND AGREE TO BE BOUND BY THE GAME TERMS. GALA RESERVES THE RIGHT, IN OUR SOLE DISCRETION TO MODIFY, ADD OR REMOVE PORTIONS OF THE GAME TERMS OF USE AT ANY TIME (“CHANGES”). IT IS YOUR RESPONSIBILITY TO CHECK THE GAME TERMS PERIODICALLY FOR CHANGES. YOUR CONTINUED USE OF PGP WILL MEAN THAT YOU ACCEPT AND AGREE TO THE CHANGES. If any change to these Game Terms is found to be invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity or the enforceability of any other change to these Game Terms. IF YOU DO NOT AGREE TO THE GAME TERMS NOW, OR IF AT ANY TIME THE GAME TERMS ARE NO LONGER ACCEPTABLE TO YOU, PLEASE CEASE USE OF PGP IMMEDIATELY.

THE GAME TERMS CONSTITUTE A BINDING AGREEMENT BETWEEN YOU AND GALA.

  1. The Game.

  • 1.1.Playing the Game

    • (a) Sweep It Poker is a simulated online poker game that offers different types of poker games and match-ups in an online setting. Winning hands are determined as described in the FAQs and/or pop-up tutorials for the Game.
    • (b) To play the Game and use PGP, You must have an active GALA Account. Setting up an account at GALA will require You to provide Your email address, phone number, mailing address and such other information as may be required.
    • (c) You may purchase a virtual non-fungible token frame (“Frame”) for use with PGP, although you do not need to purchase a Frame to play the Game and use PGP. Each Frame will supply You with a set amount of Game Chips, that will reset each day at 6:00 a.m. PST. Frames differ in terms of the amounts of Game Chips provided based on the rarity and level of the Frame and other attributes as described at the time a Frame is acquired.
    • (d) You may play the Game only if you have sufficient Game Chips in your GALA Account to play. You may purchase additional Game Chips in addition to those provided to you daily through your Frame, but no purchase is necessary to play the Game on PGP. There will always be a free-to-play mode available for any User of PGP. Play on the free-to-play mode will not allow you to earn entries into any sweepstakes offered on PGP, although you may always enter any sweepstakes for free using the alternate method of entry. Please see the applicable Official Sweepstakes Rules for full details and further information.

  • 1.2. User Conduct

    In addition to User’s agreement to User Conduct rules in the GALA Terms & Conditions, User agrees that GALA has the right, in its sole discretion, to disqualify or prohibit from playing in the Game or PGP any individual who, in GALA’s discretion, GALA determines or believes (i) has tampered with the legitimate operation of PGP by cheating, hacking, deception or other unfair practices, (ii) has engaged in conduct that annoys, abuses, threatens or harasses any other entrant or any representative of GALA or (iii) has attempted or intends to attempt any of the foregoing.

    As a condition to access the Game and PGP, You may not, directly or indirectly:

    • (a) hack into any part of the Game or PGP through password mining, phishing, or any other means;
    • (b) attempt to modify, reverse engineer, or reverse-assemble any part of the Game or PGP;
    • (c) knowingly introduce viruses, Trojans, worms, logic bombs, spyware, malware, or other similar material;
    • (d) circumvent the structure, presentation or navigational function of the Game so as to obtain information that GALA has chosen not to make publicly available on PGP;
    • (e) engage in any form of cheating or collusion;
    • (f) use the Game or PGP to facilitate any type of illegal money transfer (including money laundering proceeds of crime); or
    • (g) participate in or take advantage of, or encourage others to participate in or take advantage of schemes, organizations, agreements, or groups designed to share:
      • i. special offers or packages emailed to a specific set of Users and redeemable by URL; or
      • ii. identification documents (including, but not limited to, photographs, bills and lease documents) for the purpose of misleading GALA as to a User’s identity.

  • 1.3. Suspension or Termination of Game or PGP

    GALA has the right, in its sole discretion, to cancel, modify or suspend the Game or PGP at any time in its discretion, including without limitation if a virus, bug, technical problem, fraud or misconduct or other cause beyond the control of GALA corrupts the integrity, security or proper operation of the Game or PGP. In the event of suspension or termination of the Game or PGP, a notice will be posted on Sponsor’s Website GALA reserves the right to declare Participation in a Game void, partially or in full, if, in our sole discretion, we deem it obvious that there was an error, mistake, misprint or technical error on the pay-table, win-table, minimum or maximum stakes, odds or software.

  1. Virtual Currency

    PGP includes a virtual, in-game currency (“Virtual Currency”), in the form of chips (“Game Chips”) that may be purchased through PGP for “real world” money if you are legally permitted to purchase such Virtual Currency in your country, province, jurisdiction and/or state of residence. PGP may also include virtual, in-game digital items (“Virtual Goods”) that may be purchased through PGP for “real world” money (if you are legally permitted to purchase such Virtual Goods in your country, province, jurisdiction and/or state of residence) or for Virtual Currency. Virtual Goods, as defined and used in this paragraph and in these Game Terms, do not include the Frame NFTs or other NFTs as those terms have been defined and used in these Game Terms and in the GALA Terms and Conditions. Regardless of the terminology used, Virtual Currency and Virtual Goods (excepting Frame NFTs and other NFTs as defined in the GALA Terms and Conditions) may never be redeemed for “real world” money, goods or other items of monetary value from GALA or any other party. Pursuant to the applicable Sweepstakes Rules that may be in effect, You may receive entries into Sweepstakes based on Game Chip balances from gameplay or through free alternative methods of entry, but the specific Sweepstakes Rules in effect at the time of game play should be consulted for full rules and prize availability. Prices and availability of Virtual Currency and/or Virtual Goods are subject to change without notice. Virtual Currency and/or Virtual Goods may only be purchased or acquired from Us and through means We provide on the applicable website or otherwise expressly authorize. We reserve the right to refuse your request to purchase and/or acquire Virtual Currency and/or Virtual Goods for any reason. Virtual Currency and Virtual Goods may only be held by legal residents of jurisdictions where access to and use of PGP is permitted. Virtual Currency and Virtual Goods may only be purchased or acquired through means specifically authorized by GALA. When you purchase Virtual Currency, it will reside in your Game Account on PGP until discharged through use of PGP or otherwise surrendered as a result of termination of PGP in accordance with these Game Terms.

    Other than a limited, personal, revocable, non-transferable, non-sublicenseable license to use the Virtual Goods or Virtual Currency with PGP, you have no right or title in or to any such Virtual Goods or Virtual Currency appearing or originating with PGP, or any other attributes associated with use of PGP or stored within PGP. GALA has the absolute right to manage, regulate, control, modify and/or eliminate such Virtual Currency and/or Virtual Goods as it sees fit in its sole discretion to the extent legally permissible, and GALA shall have no liability to you or anyone for the exercise of such rights. In addition to the foregoing, GALA may selectively remove or revoke Virtual Currency and/or Virtual Goods associated with your account.

    The transfer of Virtual Currency and Virtual Goods is strictly prohibited. Any attempt to do so is in violation of these Game Terms and may result in a lifetime ban from PGP and possible legal action.

    You understand and agree that all sales of Virtual Currency and Virtual Goods are final and that GALA is not required to provide a refund for any reason. All Virtual Currency and Virtual Goods are forfeited if your account is terminated or suspended for any reason, in GALA’s sole and absolute discretion, or if PGP is no longer available. To the extent legally permissible, if your account is terminated, suspended and/or if any Virtual Currency and/or Virtual Goods are selectively removed or revoked from your account, no refund will be granted, no Virtual Currency and/or Virtual Goods will be credited to you or converted to cash or other forms of reimbursement.

  2. Termination

  • 3.1. General.

    GALA may suspend or terminate the User’s right to access or use PGP immediately and without notice if: (i) GALA determines the User’s use of PGP poses a security risk to PGP or any third party, could adversely impact GALA, PGP or any other GALA users, or could subject GALA, its affiliates, or any third party to liability, or could be fraudulent; (ii) the User is in breach of these Game Terms; or (v) for any other reason at GALA’s discretion.

  • 3.2. Effect of Suspension.

    If GALA suspends the User’s right to access or use any portion or all of PGP, the User shall remain responsible for all fees and charges the User incurs during the period of suspension, if any.

  • 3.3. Effect of Termination.

    If GALA terminates the User’s right to access or use any portion or all of PGP, then all of the User’s rights under these Game Terms immediately terminate and the User shall remain responsible for all fees owed to GALA incurred through the termination date.

  1. Malfunctions/Downtime
  • 4.1. WE DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES THAT ACCESS TO PGP, ANY OF YOUR ACCOUNT(S), OR THE GAME WILL BE CONTINUOUS, UNINTERRUPTED, TIMELY, OR ERROR-FREE.
  • 4.2. GALA has the right, in its sole discretion, at any time and from time to time, to suspend access to PGP and the Game for the purposes of conducting routine maintenance thereon or to fix technical issues in connection therewith. During such suspensions, Users may be unable to play the Game or win or purchase new Game Chips.
  • 4.3. GALA is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to Game play, nor attempts by you to play by methods, means or ways not intended by us.
  • 4.4. GALA accepts no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with PGP or the Game including, without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person’s misuse of PGP or the Game or any errors or omissions in the Game.
  • 4.5. In the event of a system malfunction all Game play on PGP is void, except to the extent specified in the Official Sweepstakes Rules for any sweepstakes in operation at the time.
  • 4.6. In the event a Game is started but fails to conclude because of a failure of the system, GALA will use commercially reasonable efforts to reinstate the amount of Game Chips played in the Game to you by crediting it to your Customer Account.
No purchase necessary. Open only to individuals who are age 18 or older and of the legal age of majority in their jurisdiction. The odds of winning depend on the number of eligible entries received. Void where prohibited and in Afghanistan, Albania, Belarus, Bosnia and Herzegovina, Bulgaria, Burma, Central African Republic, Croatia, Cuba, Democratic Republic of Congo, Ethiopia, Hong Kong, Iran, Iraq, Kosovo, Lebanon, Libya, Macedonia, Mali, Montenegro, Nicaragua, North Korea, Quebec, Romania, Russia, Serbia, Slovenia, Somalia, Sudan/Darfur, South Sudan, Syria, Venezuela, Yemen, Zimbabwe, the Crimea region of Ukraine, Donetsk People’s Republic region of Ukraine, and Luhansk People’s Republic region of Ukraine.
